Terms & Conditions

Maison du Prix Wines LLC ("Maison du Prix Wines", "we", "us" or "our") sells wine and related products (collectively "products") subject to the following terms and conditions. By placing an order with Maison du Prix Wines, the buyer ("buyer", "you" or "your") agree(s) to the following:

Location of Sale: Maison du Prix Wines' warehouse and operations are located in the State of California.  All products are sold to you in the State of California, with title passing from us to you in California at the time of purchase.  All orders delivered within California will be charged Sonoma County sales tax at the time of purchase.  Maison du Prix Wines is acting as your agent in arranging transport and we make no representations as to the legal rights of anyone to ship or import the products into any state or country. You, as the buyer, are responsible for understanding the laws regarding alcohol shipments and sales and/or use taxes or other applicable taxes that may apply to you and the location of delivery. Further, you hereby consent that you are in fact in compliance with and acting in accordance with the laws of the location of delivery. Any shipment that is seized or destroyed due to a violation of shipping laws or common carrier policies is not refundable or replaceable.

Age: By placing an order with us for wine or alcoholic beverages, you assert and affirm that you are at least 21 years of age or older and are legally able to purchase and consume alcoholic beverages. We retain the right to use reasonable means to verify a buyer's age and reserve the right to refuse to sell wine to anyone. All shipments require that the carrier verify the age of the recipient before delivery. We will comply with any legal entity in the prosecution of anyone under the age of 21 attempting to buy alcohol.

Acceptance: You agree to inspect all products upon delivery and notify us and the shipping carrier immediately (within 24 hours of receipt of delivery) in the event there is a shortage, damage has occurred, or there is some deficiency. You will be deemed to have inspected and accepted the products 24 hours after delivery.

Returns/Exchanges: Returns and refunds of alcoholic beverages, opened or sealed, is illegal in California. As a California based company, we can accept exchanges if there was an error and the wine we shipped you is not the wine you ordered. In this case, you must notify us at sales@mdpwines.com within 48-hours of delivery to facilitate the exchange for the correct wine. We are not responsible if a wine is corked (that is a winery issue), flawed, you simply don't like it and/or feel it's "over the hill" or it's damaged in transit and/or as a result of excessive heat or cold during shipment, etc.

Wine Bottle Conditions: We take every effort to ensure the wines we acquire have been well kept and are in excellent condition, or as stated in our offer or displayed in the photos we provide to you. Excellent condition, as referenced in these Terms & Conditions, is as follows: for bottles less than 20-years old, wines are deemed to be in excellent condition if they have base neck fill or better (fill within 3cm of the bottom of the cork if the bottle has no shoulder), no sign of seepage or cork failure, relatively clean and undamaged label and capsule, and good wine color. Small nicks or other marks on the label or capsule do not count against excellent condition.  For wines over 20-years old, top shoulder fill or better (within 4cm or bottom of cork if bottle has no shoulder), relatively intact label and capsule, and good wine color. Modest label and/or capsule nicks, tears, moisture stains, and mildew stains are acceptable. Discoloration or oxidation do not count against excellent condition for wines of this age. Older white wines often take on a golden or orange color and older red wines often take on a brick tone. Such color changes do not count against excellent condition if it is consistent with the wine and its age. For high value bottles of older wine, we can provide digital photos. Please submit any photo requests to sales@mdpwines.com. Note that the bottle images associated with any product listing on our site may not be the actual bottle being offered for sale.

Availability & Pricing: Prices are as quoted on our website, price list, email or such other offer communication, except in the case of obvious errors and/or omissions. Prices and availability are subject to change without notice. Due to the real-time nature of our website, and limited availability of our products, products are not removed from our site until after successful "check-out" by buyers. Invoices, verbal or written (including email) communications notwithstanding, no product is guaranteed to be available until it has been pulled from inventory and shipped. We may decline or cancel any order prior to shipment for any reason or no reason.

Force Majeure: We are not liable for any failure to meet our obligations in the event circumstances are beyond our reasonable control including, but not limited to, fire, flood, accident, earthquakes, telecommunications line failures, electrical outages, network failures, acts of God, or labor disputes.

Limitation of Liability: Our maximum liability in connection with any products purchased from us is limited to the transaction value for such product. We accept no liability for any consequential, indirect, incidental, punitive, special or exemplary losses or damages, whatsoever, including without limitation, losses or damages for any loss of profits, business interruption, loss of data or information and the like, however caused. We accept no liability for any minor errors or omissions that can remain despite the precautions taken by us in the presentation of the products.

Disclaimer of Warranties: Our website, newsletters, emails and product lists are provided on an "as is" basis without warranty, representation, condition or guarantee of any kind, express or implied, and your use thereof is at your own risk. We hereby disclaim any and all warranties, representations, conditions, or guarantees including any warranties or conditions of title and merchantability, merchantable quality, service quality, noninfringement, and fitness for a particular purpose.

Applicable Law/Venue: These terms and conditions are governed by and construed under the laws of the State of California, without regard to conflict/choice of law principles.  You hereby consent to the exclusive jurisdiction and venue of Sonoma County, California.
